TERMS AND CONDITIONS OF CAR HIRE WITH OFFUGO MOBILITY SL

 

COMPANY NAMES WITHIN THESE TERMS AND CONDITIONS 

OFFUGO MOBILITY, SL, is the legal name of the company that operates under the offUgo trademark. Either of these two names will be used interchangeably within these Terms and Conditions (hereinafter T&C) and they all refer to OFFUGO MOBILITY SL.

OFFUGO MOBILITY, SL has its registered office in Palma de Mallorca: Calle Hostalets 19 (07181, Calvia), european VAT number ESB02769974, telephone number 0034 644 319 521 and email bookings@offugo.es. Company registered in the Registro Mercantil of Palma de Mallorca in Volume 2877, Folio 61, Sheet PM-89992, Registration 1.

The client can consult the latest version of the T&C at any time through our website offugo.es.

BECOMING A CUSTOMER AND / OR BEING A DRIVER

To become a customer it is necessary to accept these T&C, the clauses relating to Data Protection and the individual lease contract, if applicable. The client must create a user account before or during the reservation process. Using the credentials, the client will be able to access the data of their reservations and make the appropriate modifications.

Likewise, the client must provide the required documentation specified in the following section so that offUgo can carry out the appropriate checks in order to verify the identity of the client and comply with legal requirements. The veracity and validity of the documentation provided is the sole responsibility of the client.

Otherwise, OFFUGO MOBILITY S.L. reserves the right to cancel the reservation and refund the amount paid by the customer.

REQUIREMENTS TO BECOME A DRIVER OR CUSTOMER

In order to rent a vehicle, customers must be over 18 years old and not over 90 years old. Those drivers with a driving license issued less than 5 years from the date of the reservation will be considered young drivers subject to additional pricing.

In order to rent the vehicle, the main driver, as well as those additional drivers who wish to be included (the inclusion of an additional driver has no cost), must send to OFFUGO the following documents through the OFFUGO mobile application or any other mean before the start of the reservation:

  • A valid ID document with picture (i.e. ID o passport).

  • A valid driving license.

  • Video selfie.

The documents must have enough quality and resolution. The quality level is set by the biometric software used for validation of documentation and identity when the software is capable of reading the information contained in the documents. 

If the documentation is not provided or if it has not enough quality, the opening of the vehicle will not be unlocked, making it impossible to start the reservation.

If the OFFUGO mobile application is not operational for any reason or the quality of the documentation is not sufficient to automatically validate the identity, it may be sent via email bookings@offugo.es and the client should contact offUgo by phone at phone number 0034 644 319 521. Validation via email may take up to 24 hours.

PICK-UP AND RETURN OF THE VEHICLE

PICK-UP: The client will be able to check the assigned vehicle in the mobile application in advance, its registration and exact location (floor and parking space, if applicable). The client will make a first opening of the vehicle through the offUgo mobile application, which will allow him/her to open the vehicle autonomously a few minutes before the official start of the reservation. The keys will be found in the locking device located in the glove compartment of the vehicle.

In the event of failure of the autonomous opening system, offUgo undertakes to deliver the vehicle and the keys (if necessary for the reserved model) in the shortest possible time.

Offugo reserves the right to carry out the delivery of the vehicle manually (always guaranteeing the minimum possible wait). If this manual delivery takes place, Offugo will notify the client through the email provided during the reservation process the new conditions of the delivery of the vehicle.

RETURN: The return will be made in the same place where the car was collected (see airport parking or selected collection point) in a place enabled for it. The customer must deposit the key in the same locking device located in the glove compartment of the car and must lock the vehicle with the offUgo mobile application. The application will request, where appropriate, the introduction of the floor and the parking space number (or any information necessary for the correct location of the vehicle) in which the vehicle has been parked.

Offugo reserves the right to carry out the reception of the vehicle manually (always guaranteeing the minimum possible wait). If this manual collection takes place, Offugo will notify the client through the email provided during the reservation process the new conditions of the collection of the vehicle.

PICK-UP AND RETURN LOCATIONS OF THE VEHICLE

  1. Mallorca Airport: We guarantee fast delivery ("express") without queues or additional costs if the client has sent all the required information, has registered in the offUgo mobile application and has accepted these T&C through any of our platforms. 

Parking ticket: the customer must pay the parking ticket to be able to leave the airport parking facilities at any of the ATMs set up for this purpose. Offugo will bring the car to the airport parking maximum 60 minutes before the customer designated pick-up time. If the customer has provided the flight number, Offugo will try to bring the car to the airport once the plane has landed. In case of early or late pick-up (between 10:00 PM and 08:00 AM) offUgo will have to leave the vehicle at the airport more that 60 minutes in advance.  The customer will cover the amount of the ticket up to a maximum of ten euros (€ 10) and if the ticket is more than ten euros (€ 10) offUgo will cover the cost above that amount. For this, the client must send a photo of the ticket and proof of payment by e-mail (bookings@offugo.es) or by WhatsApp (0034 644 319 521), as well as the data of the reservation holder, and offUgo will make the refund within the maximum period established by the stripe.com payment manager.

  1. At collection and return stations located in different establishments (hotels, car parks, etc.) on the island of Mallorca. offUgo offers its customers the possibility of collecting and returning vehicles at different points throughout the island of Mallorca, the updated list of which can be checked at offugo.es website or at the OFFUGO mobile application (if available).

In some car parks, customers who choose this modality may have parking for the entire duration of their reservation at no additional cost if specified at offugo.es.

RATES AND SERVICES INCLUDED

The official rates at which offUgo vehicles are rented will be those shown on the website (offugo.es) and on the mobile application at all times. The final amount will be shown before the reservation confirmation indicating all those services included or contracted.

All prices / rates indicated include the legally required VAT at all times.

The following services are included at no additional cost in all offUgo base rates:

  • Additional driver (except young drivers who are subject to special pricing).

  • All-risk insurance coverage subject to a franchise that will be indicated in each case through Offugo.es in the reservation process. Under no circumstances will be covered damage to tires or rims or damage caused by breaching the list of prohibited uses of the vehicle, as well as those arising from breach of current legislation.

  • Road assistance 24 hours a day.

  • Substitution vehicle in the event of a breakdown or accident that makes it impossible for the leased vehicle to circulate properly. The client must go to the offUgo facilities to collect the new vehicle. Offugo reserves the right to deliver the replacement vehicle at home to the clients it deems appropriate.

  • Unlimited mileage unless otherwise specified at the time of booking (e.g. rentals of more than 30 days may have a mileage limitation).

  • Free cancellation up to 24 hours before the start of the rental period. For more information, see the "Cancellations and modifications" section.

  • Customer service 24 hours a day by phone and email. In the event of an accident or incident of any kind, the client must notify offUgo through the telephone number 0034 644 319 521 immediately. Similarly, the customer must use the mobile application to upload images and any requested information related to the incident or accident.

CANCELLATIONS AND MODIFICATIONS

The client can cancel his/her reservation without any cost up to 24 hours before the start of the reservation. In this case, offUgo will reimburse the client for the total amount of the reservation within 7 working days.

If the reservation is canceled less than 24 hours before the start of the reservation, the customer will be charged € 55 as cancellation fees, and offUgo may deduct said amount from the amount paid by the customer. offUgo will reimburse the client for the remaining amount of the reservation, if any, within 7 working days. 

If the cancellation occurs once the reservation period has begun, the total amount of the reservation will be charged, without the client's right to any type of refund.

EXTENSIONS OF THE RENTAL PERIOD 

Any extension of the rental period must be requested to offUgo through the mobile application (if available), the telephone number 0034 644 319 521, the website offugo.es (if available) or through the e-mail bookings@offugo.es.

The extension of the reservation is not guaranteed by offUgo since it will depend on the availability of the fleet at the time of the request.

SERVICES NOT INCLUDED

The cost of the following services or extras will be those shown on the website (offugo.es) and in the mobile application at all times:

  • Young driver: drivers (main or additional) with a driving license issued less than 5 years from the start date of the reservation. The request can be made during the reservation process or later through the mobile application (if available), the website or by email: bookings@offugo.es. If it is done after the reservation, all the required documentation must be sent (see section Documentation required to be the driver of the vehicle).

  • Baby seat or child seat / booster / backrest: The request can be made during the reservation process or later through the mobile application (if available), the website or by email at bookings@offugo.es with a minimum of 5 days in advance before the start of the reservation. Otherwise its availability cannot be guaranteed.

  • Beach cooler and umbrella: The request can be made during the reservation process or later through the mobile application (if available), the website or by email: bookings@offugo.es with a minimum of 5 days before the start of the booking. Otherwise its availability cannot be guaranteed.

PAYMENT METHODS AND CONSENT OF THE INDIVIDUAL CONTRACT

Payment will be made through the offugo.es website or through the mobile application at the end of the reservation process (if available). Payment must be made by credit or debit card. Any of the cards accepted by Stripe (stripe.com) are accepted by offUgo.

Cash payments are not accepted.

The individual vehicle rental contract signed between offUgo and the client / driver is considered accepted after confirmation of the reservation through the website or mobile application.

USE OF THE VEHICLE

The rented vehicle may only be used for private use and by duly registered, declared or authorized drivers. In the event that the vehicle is used to carry out any of the situations provided below, as well as any other contrary to current legislation, offUgo reserves the right to terminate the reservation without the right of any kind of refund. offUgo reserves the right to take the legal actions it deems appropriate to obtain compensation for the corresponding damages.

USES NOT ALLOWED

  • Commercial passenger transport.

  • Pushing or towing any other vehicle or object. 

  • Smoking (or assimilated) in the vehicle or allowing them to do so.

  • Participation in car races, official or not. 

  • Carry out resistance tests of materials, accessories or any other test on the rented vehicle.

  • Drive the leased vehicle off paved roads.

  • Driving under the influence of alcohol, drugs, or medications that impair the ability to drive. 

  • Transport of goods if this transport violates the law or any current legal provision or for illegal purposes. 

  • Transport of a greater number of passengers than allowed in the technical documentation of the vehicle. 

  • Transport of goods not authorized by the technical documentation of the vehicle in terms of weight, quantity or volume. 

  • Transport of goods classified as special or dangerous by current regulations in Spain and Europe. 

  • Use of the vehicle as a mean to commit crimes, infractions or any other action sanctioned by the Law, as well as help to criminals or protection, transport or shelter of any object from this type of action. 

  • Modification of the structure of the vehicle or installation of roof racks or similar objects for the transport of goods or luggage, or any other purpose. 

  • Remove the vehicle from the geographical limits of the island of Mallorca without prior written authorization from offUgo.

  • Transport animals in the vehicle, unless they are transported in accordance with current regulations and leaving the vehicle in a perfect state of cleanliness after use.

  • Tampering with the odometer or any other part of the vehicle.

  • Refueling with incorrect fuel.

  • Driving the vehicle by an unauthorized / registered offUgo driver.

  • Carrying children or babies without the proper lift or chair.

  • Deactivate or modify the geolocation, monitoring and control tools of the Vehicle.

FUEL POLICY

All our car rentals operate under a fuel policy in which the customer must return the car with the same level of fuel with which it was collected (as a general rule, the car is delivered with a full tank and must be returned full). The customer will be able to check the fuel level on the vehicle's marker or, if available, in the offUgo mobile application. If the customer returns the car with less fuel than it had at the time of delivery, the customer will be responsible for paying the fuel costs plus an administrative management fee of € 20.

CLEANING THE VEHICLE

If the client returns the car in perfect condition, he or she will receive a 5% discount coupon for the next reservation (the cleaning criteria will be set exclusively under offUgo standards).

If the customer returns the car in extremely dirty conditions (for example: vomit, animal hair, dirt, sand, dry salt on the seats, etc.), an additional fee of € 60 will be charged for deep cleaning.

LOST OBJECTS

offUgo is not responsible for any lost or forgotten objects inside the vehicles. Clients may contact offUgo through the telephone number 0034 644 319 521 or by email at hello@offugo.es to request information on any object left in one of their vehicles.

MONITORED DRIVING AND LAW COMPLIANCE

The customer agrees to drive the car in accordance with all Spanish Law regulations in place, as well as any other applicable law, regulation or ordinance and in accordance with the technical specifications of the vehicle.

offUgo monitors the driving of the vehicle in real time throughout the rental period.

OVERCOSTS

As a summary and trying to be as transparent as possible, below you can find a list of the extra costs derived from possible actions with the vehicles, sometimes involuntary, that may occur during the reservation.

All additional costs or penalties will be paid by card at the time they are identified by offUgo or will be deducted from the excess fee (if any). 

  • Puncture or tire blowout due to impact on the rim or driving off paved roads: € 300

  • Disruption, breakage, modification or theft of the complete monitoring and geolocation device, or any of its parts: € 2000

  • No return of vehicle keys in the device intended for this: € 500

  • Return the vehicle with less fuel: the amount of fuel not replaced plus € 20 as management fee.

  • Refueling with incorrect fuel (voluntary or involuntary): € 800

  • Returning the car in a state of extreme dirt: € 60

  • Cancellation less than 24 hours before the start of the reservation: € 55

  • Cancellation once the reservation period has begun: full amount of the reserve.

  • Smoking inside the vehicle (including vapers or similar) € 200

  • Fines or sanctions: the amount of the corresponding sanction plus € 35 as management fee.

  • Return of the vehicle in a place other than the pick-up or in unauthorized places (e.g, places reserved for people with disabilities): € 200
